Welcome to Mind Healing Space (“we,” “us,” or “our”). We are an online platform designed to connect qualified, licensed therapists (“Therapists”) with individuals seeking professional mental health services (“Clients”). By accessing or using our website at www.mindhealingspace.com (“Website” or “Platform”), you agree to be bound by the following Terms and Conditions (“Terms”). Please read them carefully.

1. Acceptance of Terms
By accessing or using the Platform, you affirm that you are at least 18 years old and capable of entering into a legally binding agreement. If you do not agree with these Terms, you must discontinue use of the Platform immediately.

2. About Mind Healing Space
Mind Healing Space is a facilitator platform. We do not employ therapists or provide mental health treatment directly. Our role is to:
Allow licensed mental health professionals to create profiles and offer services.
Enable clients to browse, book, and engage with therapists.
Offer a secure and professional environment for mental health support.

3. User Categories
3.1 Therapists
Therapists must:
Be fully licensed and qualified to practice in their respective jurisdictions.
Provide accurate, updated credentials, certifications, and license information during registration.
Adhere to the ethical and professional standards mandated by their licensing boards.
Acknowledge that they are solely responsible for the services they provide, including but not limited to assessments, therapy, advice, or outcomes.
Therapists understand and agree that:
Mind Healing Space may verify their credentials at any time.
Misrepresentation may result in suspension or permanent account termination.
3.2 Clients
Clients must:
Provide truthful personal and contact information.
Use the platform only for seeking mental health support from qualified therapists.
Understand that Mind Healing Space does not control or guarantee therapeutic outcomes.
Take full responsibility for selecting a therapist and engaging in services.

4. Account Registration and Security
To access certain features, users must create an account. You agree to:
Provide accurate, current, and complete registration information.
Maintain the security of your password and account credentials.
Notify us immediately at admin@mindhealingspace.com of any unauthorized access or suspected security breach.
Accept full responsibility for all activities under your account.

5. Use of the Platform
You agree not to:
Use the platform for any unlawful purpose.
Post false, offensive, harassing, or inappropriate content.
Infringe upon any third-party rights, including copyright and data privacy.
Impersonate any person or misrepresent your identity or affiliation.
Use bots, scrapers, or other automated tools without written permission.
Mind Healing Space reserves the right to remove content or suspend users who violate these Terms.

6. Fees and Payment
Listing fees for therapists (if any) are clearly stated at the time of registration or upgrade.
Therapists may offer free or paid consultations, based on personal discretion.
Clients may be billed by therapists directly or through third-party payment systems integrated into the platform.
Mind Healing Space is not responsible for fee disputes between therapists and clients.

7. Professional Responsibility and Liability Disclaimer
Mind Healing Space is not a healthcare provider and does not provide clinical supervision or psychological services.
We do not monitor therapy sessions or provide guarantees regarding therapist qualifications beyond initial verification.
Clients are responsible for evaluating a therapist’s suitability for their needs.
Therapists are responsible for complying with all legal, regulatory, and ethical obligations in their practice.

8. Cancellations and Refund Policy
Each therapist may have their own cancellation and refund policy. Clients are advised to:
Read the therapist’s terms before booking.
Contact the therapist directly for cancellations or refund requests.
Mind Healing Space is not responsible for resolving disputes over missed sessions or dissatisfaction with services.

9. Privacy and Data Protection
Your use of the Platform is subject to our Privacy Policy. By using the Platform, you consent to:
The collection and use of your personal data in accordance with Kenyan Data Protection laws and applicable international standards.
Communications via email, SMS, or phone for service-related updates.

10. Intellectual Property
All content on the Platform (except for therapist-uploaded profiles and user messages) — including logos, text, graphics, and software — is the intellectual property of Mind Healing Space and may not be copied, reproduced, or used without prior written permission.

11. Termination of Use
We reserve the right to:
Suspend or terminate your access without notice if we believe you have violated these Terms.
Remove any content deemed harmful, misleading, illegal, or inappropriate.
You may delete your account at any time by requesting at least 1 week prior at admin@mindhealingspace.com.

12. Limitation of Liability
To the maximum extent permitted by law, Mind Healing Space:
Is not liable for any direct, indirect, incidental, or consequential damages arising from use of the Platform or services rendered by therapists.
Is not liable for any personal, psychological, or financial harm resulting from therapy sessions.

13. Third-Party Services
We may use third-party tools (e.g., payment gateways, video platforms). By using these features, you agree to their respective terms and privacy policies.

14. Indemnification
You agree to indemnify and hold harmless Mind Healing Space, its founders, affiliates, and employees from any claims, liabilities, damages, or expenses arising out of:
Your use or misuse of the Platform.
Your violation of these Terms or any applicable laws.
Any dispute between you and another user.

15. Changes to the Terms
We may revise these Terms from time to time. You will be notified of any significant changes via email or on the Platform. Continued use after changes are published constitutes your agreement to the revised Terms.
